Terms of Use
1. Agreement
These Terms are between you and Nexus Rising LLC ("we," "us"), the maker of the AudioTrove app. By downloading or using AudioTrove, you agree to these Terms. If you don't agree, please don't use the app.
2. AudioTrove today: testing stage
AudioTrove is currently available only to a limited number of testers through Google Play's testing program, and it's an early, unfinished build. Some things described in these Terms, including Google Drive as a source and the paid tiers in Section 6, aren't available yet. Those sections describe how AudioTrove is designed to work, and they apply in full once each feature ships. Nothing is being charged and no trial is running until then. We may add, change, or remove features during testing without notice.
3. What AudioTrove is
AudioTrove is a player for audiobooks you already own or are authorized to access. It plays, or is built to play, your own audiobook files, audiobooks on media servers you control (Plex, Audiobookshelf, Jellyfin, Emby), your own Google Drive once that's available, plus a small built-in shelf of free public-domain classics. AudioTrove is not a store and does not sell audiobooks.
4. License to use AudioTrove
We grant you a limited, non-exclusive, non-transferable license to install and use AudioTrove on devices you own or control, for your own personal, non-commercial use, subject to these Terms. AudioTrove is licensed to you, not sold. We and our licensors keep all rights in the app that aren't expressly granted to you here, and you may not copy, modify, distribute, sell, lease, or reverse-engineer the app except as the law allows.
5. Your content is your responsibility
You are responsible for the audiobooks you play through AudioTrove and for having the right to use them. AudioTrove is designed to play DRM-free files you own or content on servers you control. Don't use AudioTrove to access or copy content you don't have the rights to, and don't use it to get around any copy protection.
6. Free trial and one-time purchase
This section describes how AudioTrove is designed to work once purchases open; while it's in Google Play's testing program, it doesn't apply yet (see Section 2).
- AudioTrove starts with a 30-day free trial so you can evaluate it.
- The trial is for evaluation. It doesn't give you ongoing ownership of the app.
- After the trial, a one-time purchase is required to keep using the app. AudioTrove is planned to offer a Basic tier and a Pro tier, each a one-time purchase, plus a one-time upgrade purchase from Basic to Pro. There is no subscription, ever.
- We never automatically charge you. At the end of the trial the app simply locks until you choose to buy it.
- If you don't purchase after the trial, the app locks, but your data is preserved (see Section 7) and is restored the moment you purchase.
7. Your data
Your listening positions, bookmarks, and downloads are yours and are kept on your device. Deleting a downloaded book does not delete your position or bookmarks for that book. We don't hold your library or listening data on our servers. If you turn on sync, a copy of your positions, bookmarks, and other listening data is kept in your own Google Drive, under Google's terms, so your other phones can use it. (See our Privacy Policy for details.)
8. The free public-domain classics
The built-in classics are recordings we include as a convenience because we believe them to be in the public domain. They're provided as-is. Public-domain status can differ by country. If you believe any content we distribute infringes your rights, contact us at legal@audiotrove.app and we will review and, where appropriate, remove it.
9. Acceptable use
Don't misuse the app. For example, don't try to break, disrupt, or reverse-engineer it beyond what the law allows, and don't use it to infringe anyone's rights.
10. Purchases and refunds
Once purchases are available, they'll be made through Google Play and subject to Google Play's terms and refund policies. We don't process payments ourselves.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUDIOTROVE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't guarantee the app will be error-free or uninterrupted, and we're not responsible for your servers, your network, your files, or third-party services (such as Plex, Google Drive, or your media-server software). Some jurisdictions don't allow the exclusion of certain warranties, so some of the above may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Nexus Rising LLC is not liable for indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of AudioTrove. Our total liability for any claim relating to the app will not exceed the amount you paid for it. Nothing in these Terms limits liability that cannot be limited by law (such as liability for death or personal injury caused by negligence, or for fraud), and nothing affects the mandatory statutory rights of consumers where those apply. Some jurisdictions don't allow these limitations, so some may not apply to you.
13. Changes
We may update these Terms. If we do, we'll change the date above and post the new version here. Continuing to use the app after a change means you accept the updated Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute that is not otherwise resolved will be brought in the state or federal courts located in Georgia, and you and we consent to that venue, except where mandatory local consumer law gives you the right to bring a claim in your home jurisdiction.
15. General
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the app.
- Assignment. You may not transfer your rights under these Terms; we may transfer ours to a successor (for example, if the business is sold).
- No waiver. If we don't enforce a provision, that isn't a waiver of it.
- Language. These Terms are written in English, the official and controlling version. Any translation is provided for convenience only; if there is any conflict, the English version governs, except where mandatory local consumer law requires otherwise.
